This is a binding legal agreement ("Agreement"). Please read these Terms of Service ("Terms") carefully before using this website and/or mobile application. These Terms apply to all websites and digital platforms (collectively, the “Apps”) operated by The Bellwether Hotel and its affiliates ("The Bellwether," "we," "our," or "us").
By using the Apps, you agree to these Terms and any additional terms and conditions, whether referenced here or not. If you do not agree, please discontinue use immediately. We may modify these Terms at any time without prior notice; such modifications will become effective upon posting. Your continued use of the Apps following any changes constitutes your acceptance of those changes.
1. USE OF THE APPS
The Bellwether’s Apps are intended for adults. To use our services, you must be at least 18 years old and capable of entering into legally binding agreements. Additional terms may apply to reservations, purchases, promotions, or other services accessed through our Apps.
You agree:
To make only legitimate, good-faith reservations and purchases.
Not to use the Apps for speculative, false, or fraudulent purposes.
That we may cancel or modify any reservation we believe to be in violation of these Terms or of our property policies.
Not to interfere with the functionality of the Apps, nor use any scraping, data mining, or unauthorized monitoring tools.
Not to post unlawful, offensive, defamatory, obscene, or otherwise objectionable content.
That we may restrict or terminate your access to the Apps at any time if you violate these Terms.
2. INTELLECTUAL PROPERTY
All content, trademarks, photography, designs, text, and other materials displayed on the Apps are the intellectual property of The Bellwether or its licensors. You are granted a limited, non-transferable license to access and use this content for personal, non-commercial purposes only. Reproduction, modification, distribution, or republication without our express written consent is prohibited.
3. USE OF SMS TEXT MESSAGING
By booking a stay or engaging with us digitally, you may receive SMS text communications from The Bellwether Hotel (e.g., check-in instructions, updates, guest communication). 4. THIRD-PARTY LINKS
The Apps may include links to third-party websites or services for your convenience. We do not endorse or assume responsibility for the content, privacy practices, or accuracy of those third-party sites. Use them at your own discretion and risk.
You must obtain prior written consent from The Bellwether before linking any website to our Apps. Some sections of the Apps may display third-party advertisements, which may use cookies or tracking technologies beyond our control.
5. DISCLAIMERS
The Bellwether provides the Apps and associated services “as is,” without warranties of any kind.
We do not guarantee uninterrupted or error-free operation, nor do we warrant that defects will be corrected.
You are solely responsible for securing your devices and protecting your information.
Transmission of data via the internet and the Apps is not guaranteed to be private or secure.
We make no warranties regarding availability, accuracy, or completeness of content on the Apps.
6. SUBMITTED CONTENT
While we appreciate guest feedback, we do not accept unsolicited creative ideas, concepts, or materials. If you submit content voluntarily or in response to a specific request (e.g., reviews, suggestions, creative input), you agree that such submissions:
Become the property of The Bellwether.
Are not confidential.
May be used in perpetuity, without compensation or attribution, for any purpose.
7. INDEMNIFICATION
You agree to indemnify and hold harmless The Bellwether, its officers, owners, affiliates, and staff (collectively, the “Indemnified Parties”) from any and all claims, damages, costs, or liabilities arising from your use of the Apps, breach of these Terms, or violation of third-party rights. If a claim is made, you agree to cooperate fully in its defense, and we reserve the right to assume control of the legal response at our own expense.
8. LIMITATION OF LIABILITY
To the fullest extent permitted by law, The Bellwether is not liable for any indirect, incidental, or consequential damages—including but not limited to lost profits—arising from:
Your use or inability to use the Apps;
Any unauthorized access or use of your personal information;
Errors, bugs, viruses, or technical issues.
Our total liability will not exceed the amount you paid (if any) for using the Apps. Your sole remedy for dissatisfaction is to stop using the Apps.
All claims or actions related to these Terms must be brought within one (1) year of the incident.
9. CLASS ACTION WAIVER
You expressly waive the right to participate in any class action lawsuit, class arbitration, or representative proceeding against The Bellwether.
10. SEVERABILITY
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Any unenforceable terms shall be replaced or interpreted to reflect the original intent of the parties as closely as possible.
11. JURISDICTION & GOVERNING LAW
The use of our Apps and these Terms are governed by the laws of the Commonwealth of Kentucky, USA. Any disputes will be resolved in the state or federal courts located in Jefferson County, Kentucky, and you consent to their exclusive jurisdiction.
If use of the Apps is unlawful in your jurisdiction, you are not authorized to use them.
12. DIGITAL AGREEMENT
By using the Apps, you represent that you have the legal authority to accept these Terms on behalf of yourself and/or any party you represent. Your use constitutes an electronic signature under the Electronic Signatures in Global and National Commerce Act (E-SIGN) and Uniform Electronic Transactions Act (UETA).
